New Virginia Birthday Rule Effective 07/01/2025
A new birthday rule in the state of Virginia will go into effect July 1, 2025.
The rule consists of an annual open enrollment period, lasting 60 days, beginning on an individual’s birthday. During this time, an individual may purchase the same Medicare supplement plan they currently have with a different insurer in the state of Virginia.
Coverage will not be made effective prior to the individual’s birthday or beyond 60 days from the application date. Producer compensation will be paid as guaranteed issue.
This new birthday rule has a requirement to notify each individual, to whom such open enrollment period applies, of their rights during the open enrollment period, and of any modification of benefits provided by or adjustment of premiums charged for such Medicare supplement policy. The notification must occur at least 15 days, but not more than 30 days prior to the commencement of the annual open enrollment period.
Within the month of June, policyholders with July birthdays will receive a letter informing them of this open enrollment period. Policyholders with birthdays prior to the July 1, 2025 effective date of this rule are not eligible.
