2024 FMIAGENT POINT AWARDS TRIP INVITED PRODUCER AGREEMENT
Financial Markets Inc, a SD corporation with offices located at 1540 Samco Rd Suite A, Rapid City, SD, and Person(s) Invited to Register at https://www.fmiagent.com/spring-2025-fmiagent-point-awards-invited-guest-registration (“Invited Financial Professional”) hereby enter into this Agreement (the "Agreement") regarding the 2024 fmiAgent Point Awards trip via Celebrity Summit Cruise.
2024 fmiAgent Point Awards trip via Cruise Line trip detail:
Dates: Saturday, April 5, 2025 through Thursday, April 10, 2025
Vessel: Celebrity Summit
Initial Embarkation Port: Fort Lauderdale, Florida
Enroute Destination Ports: Puerto Plata (Dominican Republic) and Nassau (Bahamas)
Final Disembarkation Port: Fort Lauderdale, Florida
Financial Markets Inc agrees to provide services and/or professional recommendations as follows:
Facilitate the booking of staterooms on the 2024 fmiAgent Point Awards trip via Cruise Line contingent upon receipt of full payment as agreed upon within this Agreement.
Financial Markets Inc is not engaged in making profit for travel accommodations or arrangements. Financial Markets Inc is providing the service explained herein to accommodate our business associates the opportunity to participate in the 2024 fmiAgent Point Awards trip group travel by invitation without qualifying through our normal promotion outlined at www.fmiAgent.com.
Invited Financial Professional(s) agrees to the following:
Agrees to be attentive to Financial Markets Inc communications.
Give his/her due diligence to relevant travel warnings.
Agrees to take responsibility for completing travel specific duties, including all arrangements and costs associated with travel to and from the cruise ship before, during, and after the cruise.
Invited Financial Professional(s) agree to make full payment for their room(s) as noted in this Agreement upon acceptance.

The price of the Cruise includes ship accommodations, ocean transportation, most meals, certain nonalcoholic beverages and most entertainment aboard the Vessel. Unless otherwise provided in this Agreement, the Cruise price does not include air transportation; transfers; optional shore and land excursions; meals and accommodations ashore; certain beverages; photographs; additional gratuities; telephone calls; specialty restaurants, onboard certain vessels; purchases from the ship stores or items of a personal nature, such as medical services, laundry, massages, spa treatments, hairstyling or manicures. Some of these items may be purchased separately.
As provided more specifically in the Cruise Line Ticket Contract, departure and arrival times are not guaranteed and any part of the itinerary is subject to delay, and to port of call cancellation occasioned by weather conditions, exigencies of safe navigation, navigation through regulated waters, ports and channels and other causes beyond the control of the Cruise Line and may be changed at any time at the Cruise Line's sole discretion. In the event of a conflict between this Section and the Cruise Line Ticket Contract, the terms of the Cruise Line Ticket Contract shall govern. A copy of the current Cruise Line Ticket Contract is available at the Cruise Line website.
Cruise Line will use commercially reasonable efforts to notify (via facsimile, email, consumer website post or otherwise) Financial Markets Inc and Invited Financial Professional(s) of any itinerary changes; provided, however, the Cruise Line and Financial Markets Inc is not responsible for any incorrect facsimile numbers or email addresses, inoperable facsimiles or the lack of receipt of any such itinerary change notice if such notice was sent by Cruise Line to Invited Financial Professional. Invited Financial Professional is also advised itinerary change notices are frequently posted on the Cruise Line consumer website.
TERMS AND CONDITIONS:
Invited Financial Professional(s) authorizes Financial Markets Inc to book a cruise room with Cruise Line on their behalf. Invited Financial Professional(s) accepts that Financial Markets Inc is NOT responsible for, nor will Invited Financial Professional(s) attempt to hold it liable for any injury, damage or loss suffered for any conditions, actions or omissions that are beyond the reasonable control of Financial Markets Inc.
Invited Financial Professional(s) understands when traveling internationally all persons must have a valid passport book. Invited Financial Professional(s) understands a passport card is not valid for air travel. Depending on destination and the origin of Invited Financial Professional(s) passport, guests may need to obtain a visa. Proof of citizenship is required for travel outside the United States.
In the unlikely event that a catastrophic situation should occur to redirect or reschedule travel plans and the supplier is unable to provide Invited Financial Professional(s) with the agreed upon travel services and/or products, Financial Markets Inc is not responsible for any damages, economic, social, emotional or otherwise. If Cruise Line is forced to cancel the Cruise due to Acts of God, breakdown of the Vessel, hostilities, blockades, labor conflicts, strikes aboard or ashore, restraint of rules principles or peoples, war, fire, collision, directions of underwriters, arrest, order or restraint by governmental authorities or others (including due to the actions of port officials or government-imposed travel restrictions), acts of terrorism, civil commotions, embargo, weather conditions or considerations of safety of the Vessel (of which the Cruise Vessel Master shall be the sole judge), foundering of the Vessel or breakdowns of or damage to its hull, machinery and fittings, inability to secure or failure of supplies including fuel, requisition of the Vessel, disease, epidemic or pandemic, or other circumstances beyond the Cruise Line’s control (including but not limited to a change in the Cruise Line fleet deployment caused by any of the aforementioned events) (collectively such causes shall be referred to as “Force Majeure Events”), the sole liability of Cruise Line, and/or the Vessel, shall be for a refund of all monies theretofore paid by the Financial Markets Inc to Cruise Line hereunder for all obligations not then performed or for which the Invited Financial Professional has not had benefit.
CANCELLATION AND REFUND POLICY:
Financial Markets Inc agrees to refund all monies as described above to the Invited Financial Professional, not to exceed the amount paid by the Invited Financial Professional to Financial Markets Inc. For the avoidance of doubt, under no circumstances will Cruise Line or Financial Markets Inc be obligated to refund any cancellation charges incurred pursuant to their cancellation policy as contracted between the Cruise Line and Financial Markets Inc as described here:

Between 03/07/2025 and 03/28/2025 50% of total cruise fare (including the Non-Commissionable Cruise Fares) for space cancelled
Between 03/29/2025 and 04/05/2024 No refund (except taxes, fees, port expenses and gratuities)
ALL CANCELLATION REQUESTS MUST BE MADE IN WRITING VIA EMAIL, FACSIMILE OR US POSTAL SERVICE. CANCELLATION REQUESTS ARE NOT VALID UNLESS CONFIRMED IN WRITING BY FINANCIAL MARKETS INC.
ASSUMPTION OF RISK:
By accepting this Agreement, I/we Invited Financial Professional(s) acknowledge awareness that participation in the 2024 fmiAgent Point Awards trip carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks may vary depending on the activity in which I am participating. Invited Financial Professional(s) acknowledge that Financial Markets Inc makes no representation as to the safety or suitability of any activities in which Invited Financial Professional(s) may be invited to participate, nor will Financial Markets Inc make any other efforts to ensure my safety related to Invited Financial Professional(s) participation in activities. It is the responsibility of the Invited Financial Professional(s) to conduct any and all due diligence on any proposed activity Invited Financial Professional(s) may wish to participate in. Invited Financial Professional(s) has read the statements above and understands and appreciates these and other risks that are inherent in the 2024 fmiAgent Point Awards trip and associated activities. Invited Financial Professional(s) hereby asserts participation is voluntary and knowingly assumes all such risks.
INDEMNIFICATION AND HOLD HARMLESS:
Invited Financial Professional(s) agrees to indemnify and hold harmless all Parties from any liability, actions, causes of action, claims, or demands of any nature whatsoever, as a result of any personal injury, property damage, permanent disability, or death that may occur in connection with my participation in the 2024 fmiAgent Point Awards trip.
SEVERABILITY:
Invited Financial Professional(s) expressly agrees this Agreement is intended to be as broad and inclusive as is permitted by the law of the State of South Dakota and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.(Required)
