Oregon Regulation Changes Effective 03/15/23

The State of Oregon (OR) has updated their regulations relating to specific Guaranteed Issue periods and has created a New Open Enrollment period for Medicare Supplement policyholders, with a disability, who are under age 65 and have recently move to Oregon. We have updated our Underwriting Guidelines and internal systems to match these regulations. All the listed changes are effective immediately. See below for details:

Birthday Rule

  • OR updated their regulation to allow effective dates for the Birthday rule to be 30 days prior to an applicant’s birthday.
  • See Underwriting Guidelines pdf, page 12 for details.

MA Trial Right

  • OR amended the Medicare Advantage Trial Right to allow individuals to be eligible for the Guaranteed Issue period when first eligible for Medicare Part A or within six months of enrollment in Medicare Part B.
  • We have updated the OR Open Enrollment/Guaranteed Issue Worksheet in the application packet with this information.

Under Age 65 Move Open Enrollment Period

  • OR has created a special Open Enrollment (OE) period for those who are under age 65, who move to OR and qualify for Medicare due to disability. This enrollment period is for those who move to OR from a state that does not require the sale and issue of policies to under age 65 individuals.
  • This OE period begins on the day residency has been established in OR and ends 63 days after.
  • OR Applicants should provide one of the following items for Proof of Residency: driver’s license, piece of mail or voter registration AND must provide a statement in writing indicating the state they moved from, that they are now a resident of OR and the date they established residency.
  • A paper application must be submitted for this OE Period. We will not be adding this OE period to our e-App at this time.
  • When filling out the paper application, please put a comment in Section J, stating the applicant is eligible for this period and attach the required documentation to the application.
  • All applications submitted will be coded as Open Enrollment.
